'FoundME' or 'Platform' these are functions and services that we make available, including via (a) our website at www.foundme.co and other websites or applications of the FoundME brand or through co-branding (including subdomains, international versions, widgets and mobile versions); (b) our platform; (c) other media, brands, products, services, software, devices or networks that currently exist or are developed at a later date. FoundME reserves the right, in its sole discretion, to stipulate that some of our brands, products or services are governed by separate conditions and not by these Terms and Conditions.
'Content’ this is everything that you and other users post, deliver, or share by using FoundME.
'Data', 'user data' or 'data from the user' this is all data, including the content or information of a user that you or a third party can retrieve from FoundME or can provide to FoundME via the platform.’Posting’ this is posting to FoundME or otherwise making available by using the platform.
'Use and using' this is using, executing, performing, copying, publishing or displaying, distributing, modifying, translating and creating derivative products from.
'Specialties' or 'Skills' are the specific interest and knowledge fields that you communicate to us.
'Offers' are the things that you can offer to other users and which you inform us of.
'Profiling' is placing people in similar categories in an unidentifiable way.
'Organization Page' are both standard FoundME business pages and LANES pages.
’LANES by FoundME’ is a separate package group from FoundME, also known as FoundME’s Platform as a Service solution.
These conditions apply to the website foundme.co en foundme.be hereinafter referred to as "the website". The website is owned and managed by FoundME BVBA with registered office at Franklin Rooseveltlaan 349/B51, 9000 GHENT BELGIUM, registered under company number 0688.673.967, hereinafter referred to as "FoundME" (contact; hello[at]foundme[dot]co).
By using the website, reading articles or consulting the website in any other way and/or making use of it in any other way, you declare that you agree with the following terms and conditions and you undertake to comply with them. These are the only ones valid, with the exclusion of any other conditions, and apply to all services and initiatives of FoundME.
FoundME operates a web platform where ecosystems are supported. For example, FoundME brings entrepreneurs into contact with each other according to competences and necessity and FoundME bridges the gap with supporting organizations within the ecosystem. The purpose of the web platform is to digitally guide startup founders through the entrepreneurial process. Every user is granted a limited right of use and display on the platform of FoundME (hereafter: "the usage right"). The scope of this usage right will vary according to the registration, the capacity of the user and the functionalities that the user has at his disposal (for example, Organization pages or the LANES package). This usage right is provided in the form of a limited, revocable, non-exclusive and non-transferable license. This license does not entitle the user to sell, to copy, to transfer or to license the services of FoundME in any kind whatsoever.
For content subject to intellectual property rights, like photos and videos, indicates the user to FoundME a non-exclusive, transferable, (sub)licensable, royalty-free and worldwide license for the content that the user places on or in connection with FoundME (hereinafter 'IE license').
Access to the services of FoundME is limited to registered users. Every registration requires the user to provide a correct, truthful, up-to-date and complete depiction. FoundME can regard certain information as essential for a registration. It is the sole responsibility of the user to keep the information up-to-date.
Each user profile is individual, personal and confidential and can not be transferred to third parties. FoundME does not check the profiles, but reserves the right to make changes if a user does not comply with the rules regarding registration and security, as defined below:
FoundME does its best to keep the platform safe, but cannot guarantee this. We need your help to keep the platform safe. In addition, the usage right has limits. Use may not be contrary to our terms and conditions, the rights of third parties and the laws. Therefore, you must adhere to the following (non-limitative) rules:
FoundME can take unilateral sanctioning or remedial measures if a user would act in violation of these terms and conditions or the rights of third parties and the laws known to him. For example, FoundME has the possibility to implement a temporary or permanent suspension of the usage right. The user can also be completely or partially denied access to the functionalities on the platform. Finally, FoundME can proceed with the removal of the user profile.
The user is not entitled to compensation of any nature whatsoever, following the aforementioned measures.
The information that FoundME itself places on the website is the result of meticulous research and analysis. Nevertheless, the information is delivered and displayed without any form of guarantee. The information distributed via banners, html pages, flash, photos, videos, articles or other media provided by third parties are not the responsibility of FoundME. FoundME is not responsible for the accuracy, completeness, usability, reliability and topicality of the information on the site and for the consequences of any action/decision taken on the basis of the information provided.
FoundME does not guarantee that the platform will always be safe, secure or error-free or that it will always work without malfunctions, delays or irregularities. Disruptions, interruptions or errors in the electronic delivery of our services through our website do not in any case give rise to any reimbursement or compensation. FoundME is also not liable for possible viruses, if these, despite the precautions taken on the site, would occur. FoundME cannot be held liable for any damage whatsoever caused by an error and/or negligence committed by subcontractors of FoundME or a fraudulent forgery of information after unauthorized intrusion into the website.
This website may contain hyperlinks to websites or to web pages of third parties and other parties, or refer to them in a different way. FoundME has no control over the content or other characteristics of these websites or web pages and is in no way liable for their content or characteristics. The placement of links by FoundME in no way implies an implicit approval of the content of these websites or web pages. You can create a hyperlink to the homepage of FoundME on your own website. Due to privacy regulations, you cannot make a deep link to specific content on our website.
If someone files a claim against FoundME relating to unlawful acts of a user, content or information on FoundME, that user indemnify FoundME against all damages, losses and expenses related to such claim (including reasonable legal fees and costs). While we provide rules for user behaviour, we do not monitor or control user actions on FoundME and are not responsible for the content or information that users transfer or share on the platform. We are not responsible for any offensive, inappropriate, obscene, illegal, or otherwise condemnable content or information available found on FoundME. We are not responsible for the online or offline behaviour of our users. We try to keep FoundME online, error-free and secure, but you use the platform at your own risk. We offer the platform as it is, without express or implied warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-compliance.
The liability of FoundME is also limited to the amount the user paid in the past six (6) months, whatever law is applicable.
Any fact that could give rise to liability of FoundME must also be reported to FoundME in writing and with reasons within seven days of the discovery of that fact, in default of which the user can no longer hold FoundME liable and waives any claim against FoundME, of any kind, arising from that fact. This short term is motivated by the need to be able to make the necessary observations quickly and accurately.
The user owns all content and information posted on FoundME and can use the privacy settings to determine how the content and information is shared.
It is the sole responsibility of the user to contact everyone who has cooperated with the work that the user wants to post on the website (people who have participated in the work, the people who were depicted and the parties that acquired rights after creation). In any case, the user guarantees to FoundME free and undisturbed use of all works posted on the FoundME website and/or platform and the user will indemnify FoundME against any claim in this respect. If the user is in the opinion that its rights are violated by material that was posted on the websites or the platform FoundME, the user can report any breaches via hello[at]foundme[dot]co. We undertake to review your appeal as a matter of priority and remove the material if necessary. The IE license ends when the user deletes his IE content or account, unless the user has content shared with others and they did not remove the content. When the user deletes IE content, it is removed in a manner similar to emptying the trash can on a computer. The user acknowledges and understands that deleted content may remain present in backups for a reasonable period of time (but is not available to others). When the user publishes content or information with the Public setting, it means that everyone, excluding people outside of FoundME, has permission to view and use that information and associate with the user (ie name, profile picture, location & specialties).
We respect the rights of others and expect the user to do so, too.
The user cannot post content or take action that violates another person’s rights or violates the law in any other way We may remove content and information you post on FoundME if we consider this to be violating our policies. If we have removed content for violating another person’s copyright and the user believes it is unjustified, the user can raise an appeal via hello[at]foundme[dot]co If the user repeatedly infringes the intellectual property rights of others, we will deactivate the account. The user will not use our copyrights, trademarks or brands that appear to be confusing in this way, except when this is expressly permitted in writing.
The user may not post identity documents or sensitive financial information of others on FoundME.
Our goal is to provide commercial or sponsored content that is valuable to our users. To help us with this, the user agrees to the following (see also Profiling): the user gives us permission to anonymously use content and information (such as which types of profiles the user follows) to display commercial or related content or to improve it. Owners of Organization Pages receive statistics from FoundME based on the Profiling of the profiles of the users. This information is always anonymous and contains no identifiable elements. The user has the option to disable Profiling for Organization Pages.
Consistent with the Privacy Guidelines, FoundME has chosen not to work with identifiable user data at any time. Users are categorized on the basis of their business stage, industry, skills, age category, location, and platform usage. This information is used to optimize our platform operations and the user experience. As stated in Privacy Guidelines, the user can choose to disable this Profiling so that the statistics of Organization Pages do not take the user’s profile into account. Because the operation of the FoundME platform depends strongly on this Profiling, the user cannot turn this off for the entire platform.

Any claims, legal proceedings or disputes that the user has with us, can only be processed before the courts of the District of Ghent, Belgium and are subject to the laws of the country of Belgium.
